what exactly is an accident claim?

I’m writing an article about accidents for my school newspaper and I want a clear definition of what an accident claim is to make my point clear to readers.

If you have an accident, and you have insurance, you call your insurance company and they have a guy who interviews you and decides what you are entitled to. You have a ‘claim’, which is a legal word meaning that someone owes you something and you have the right to ask them for it. You are ‘filing a claim’.

If the accident wasn’t your fault, you go to the person whose fault it was and you tell him how much you think he should give you for your damages, plus your inconvenience, for ‘pain and suffering’, etc. If he has insurance, you work with his insurance company, and they make you an offer. If he doesn’t have insurance, you mail him a letter telling him how much you want, and the sum is usually negotiated. You might have to sue him. You have a ‘legal claim’.
